12. Dispute Resolution

YOU AGREE THAT ALL CLAIMS, WITH THE EXCEPTION OF CLAIMS RELATED TO INTELLECTUAL PROPERTY, WILL BE RESOLVED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION. If your claim qualifies under Small Claims Court, you may also bring your claim there. For any claim that is not arbitrated or resolved in Small Claims Court, you agree that it will be resolved exclusively in the state courts located in Colorado Springs, Colorado or the U.S. District Courts in El Paso County, Colorado. You expressly waive a trial by jury.
13. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. All revised terms will be published on our Website, so we encourage you to check back periodically for updates. 14. Termination

Beta Test Terms and Agreement – Personal Cyber Advisor
Effective Date: November 18, 2025
Service: Personal Cyber Advisor Beta Test Program
Owner: National Cybersecurity Center (“Company”, “we”, “our”, or “us”)
By registering for and participating in the National Cybersecurity Center Beta Test Program (“Beta Program”) for National Cybersecurity Center Personal Cyber Advisor, you (“Participant”, “you”, or “your”) agree to these Terms and Conditions.
1. Purpose
The National Cybersecurity Center Beta Program provides participants with early access to the National Cybersecurity Center Personal Cyber Advisor for testing and feedback. Participation is voluntary, without compensation unless otherwise stated.
2. Eligibility
Participants must be at least 18 years old and legally able to enter into agreements. The Company may revoke access at any time.
3. Confidentiality
Participants may access confidential information in the National Cybersecurity Center Beta Program. You agree not to disclose, share, or copy any part of the service or related materials without written permission.
4. Feedback
Any feedback, suggestions, or comments provided may be used by the Company without obligation to compensate. All rights to feedback become the exclusive property of the Company.
5. Data and Privacy
Use of the National Cybersecurity Center beta service may involve the collection of usage data and analytics to improve the service. Personal information will be handled in accordance with our Privacy Policy.
6. Acknowledgement of Beta Status
You acknowledge and agree that the National Cybersecurity Center Personal Cyber Advisor provided through this National Cybersecurity Center Beta Program is in development, is not a final product, and may be incomplete, have flaws, or operate unpredictably. The service may experience errors, bugs, or discrepancies, and features or content may change or be removed without notice. By using the National Cybersecurity Center Beta Service, you accept these limitations and understand that the Company makes no guarantee regarding the reliability or accuracy of the service during the Beta period.
7. No Warranties
The National Cybersecurity Center Beta version of the National Cybersecurity Center Personal Cyber Advisor is provided “as is” and “as available,” with all faults and without warranty of any kind, express or implied. The Company disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement. The Company does not guarantee the service will be error-free, uninterrupted, or that any defects will be corrected.
8. Limitation of Liability
To the fullest extent permitted by law, the Company, its officers, directors, employees, or affiliates, shall not be liable for any damages including but not limited to loss of data, profits, business, or reputation arising out of or in connection with the use of, inability to use, or reliance upon the National Cybersecurity Center Beta Service, including any flaws, errors, or incomplete features known or unknown at the time of use.
9. Term and Termination
This Agreement remains in effect until the National Cybersecurity Center Beta Program ends or either party terminates participation. You may withdraw at any time; the Company may terminate access without prior notice.
10. Intellectual Property
All rights in the National Cybersecurity Center Personal Cyber Advisor and related materials remain with the Company. Participation does not transfer or grant any rights to you.
11. Governing Law
This Agreement is governed by the laws of Colorado.
12. Entire Agreement
This Agreement supersedes all prior discussions and represents the entire understanding between parties regarding the National Cybersecurity Center Beta Program.
13. Future Changes
We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions at any time. All revised terms will be published in the Personal Cyber Advisor Beta Test Program, so we encourage you to check back periodically for updates. By continuing to access or use the Personal Cyber Advisor Beta Test Program after those revisions become effective, you agree to be bound by the revised terms.
By clicking “I Agree” or participating in the National Cybersecurity Center Beta Test, you acknowledge that you have read, understood, and accepted these Terms and Conditions, including the specific risks and limitations associated with the use of pre-release, developmental software.

This Agreement remains effective until the end of the National Cybersecurity Center Beta Program or either party terminates participation. You may withdraw at any time; the Company may terminate access without prior notice.
10. Intellectual Property
All rights in the National Cybersecurity Center Alerts service and related materials remain with the Company. Participation does not grant or transfer any rights to you.
11. Governing Law
This Agreement is governed by the laws of Colorado.
